About this Visa

The visa has three streams:

  • Short-term, a visa period up to two years* with one onshore extension of two years (unless an ITO applies). Must meet Genuine Temporary Entrant (GTE) requirements. No pathway to permanent residence
  • Medium-term, a visa period up to four years* (unless an ITO applies) with no limit on number of onshore renewals. Offers pathway to permanent residence
  • Labour Agreement, an agreement negotiated between the Australian Government and employers. Duration of visa and occupations available will depend on the agreement

*Note:  Hong Kong passport holders may stay up to 5 years

Eligibility

While there is no age requirement, applicants must:

  • be nominated by an approved sponsor for an occupation listed on the relevant list of eligible skilled occupations and in the stream identified by this list
  • work for a nominating employer
  • have relevant skills, qualifications and employment background to perform the occupation
  • have worked in the nominated occupation or a related field for at least two years in Australia or overseas
  • hold, or be eligible to apply for, any mandatory licencing or registration required to work in the occupation
  • have a positive skills assessment where required
  • meet health and character requirements
  • meet the English language requirements for the proposed stream (if required)

 

Processing times

Unless the expat you wish to sponsor is in an occupation that is prioritised (see below PMSOL list of occupations), the current processing times for the 482 visa is approximately 4-6 months from lodgement.

Impact of Covid-19

Priority Migration Skilled Occupation List (PMSOL)

While visa applications are still being processed, the Department of Home Affairs has advised that due to the impact of Covid-19, priority processing will be given to those occupations filling urgent skills needs in critical sectors such as:

  • Chief Executive or Managing Director (111111)
  • Construction Project Manager (133111)
  • Mechanical Engineer (233512)
  • General Practitioner (253111)
  • Resident Medical Officer (253112)
  • Psychiatrist (253411)
  • Medical Practitioner nec (253999)

Processing times

If the 482 visa application is prioritised with the above occupation, processing times from lodgement are approximately 2-4 weeks.

Travel Waiver

Limited flights are currently available to and from Australia and travellers from overseas are not allowed to enter the country unless they are in an exempt category or have been granted an individual exemption to the current travel restrictions.

Most travel exemption requests to come to Australia are finalised within 7 days, but some complex requests may take longer.

Exempt categories

Persons are automatically exempt from the travel restrictions and can enter Australia (without obtaining an individual exemption) if they are:

  • an Australian citizen
  • a permanent resident of Australia
  • an immediate family member of an Australian citizen or permanent resident*
  • a New Zealand citizen usually resident in Australia and their immediate family members
  • a diplomat accredited to Australia (holding a subclass 995 visa)
  • a traveller transiting Australia for 72 hours or less
  • airline crew
  • maritime crew including marine pilots
  • recruited under the Government approved Seasonal Worker Program or Pacific Labour Scheme
  • holder of a Business Innovation and Investment (subclass 188) visa
  • travelling from New Zealand by air and have been in New Zealand 14 days prior to travel

Individual Exemptions

The Commissioner of the Australian Border Force may grant an individual exemption to a non-citizen:

  • travelling at the invitation of the Australian Government or a state or territory government authority for the purpose of assisting in the COVID-19 response
  • providing critical or specialist medical services, including air ambulance, medical evacuations and delivering critical medical supplies
  • with critical skills required to maintain the supply of essential goods and services (such as in medical technology, critical infrastructure, telecommunications, engineering and mining, supply chain logistics, aged care, agriculture, primary industry, food production, and the maritime industry)
  • delivering services in sectors critical to Australia’s economic recovery (such as financial technology, large scale manufacturing, film, media and television production and emerging technology), where no Australian worker is available
  • providing critical skills in religious or theology fields
  • sponsored by your employer to work in Australia in an occupation on the Priority Migration Skilled Occupation List (PMSOL)
  • whose entry would otherwise be in Australia’s national interest, supported by the Australian Government or a state or territory government authority.

Note: Unless arriving on a quarantine-free flight from New Zealand, all travellers arriving in Australia, including Australian citizens, must quarantine for 14 days at a designated facility and may be required to pay for the costs of quarantine.
